Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a pedestrian right of way. The applicant claims the pedestrian right of way is redundant by reason of the circumstances set out below.
I intend to remove the pedestrian right of way on 7 May 2009 if no objections have been received before that date.

Applicant: Wellington City Council, c/o DLA Phillips Fox, PO Box 2791, Wellington.
Easement: Pedestrian right of way over Lot 1 DP 365302 and over stratum estate DP 365999; marked “A” on DP 365302 (comprised in Computer Freehold Register 264722 and Supplementary Record Sheet 267492) appurtenant to Lot 3 DP 389044 (comprised in Computer Freehold Register 356147), created by easement instrument 6892562.6, registered on 2 June 2006.
Circumstances: The dominant tenement has become physically separated from the servient tenement caused by the strata freehold subdivision on DP 389044.
