Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a pedestrian right of way. The applicant claims the pedestrian right of way is redundant by reason of the circumstances set out below.
I intend to remove the pedestrian right of way on 7 May 2009 if no objections have been received before that date.

Applicant: Chews Lane Developments Limited, c/o Morrison Kent, PO Box 10035, Wellington.
Easement: Pedestrian right of way over Lot 1 DP 363521; marked “A” on DP 363521 (comprised in Computer Freehold Register 258139) appurtenant to Lot 3 DP 389044 (comprised in Computer Interest Register 410925), created by easement instrument 6856094.14, registered on 8 May 2006.
Circumstances: The dominant tenement has become physically separated from the servient tenement caused by the airspace that exists above the existing buildings on the servient tenement. The location of the airspace is marked “A” on DP 389044.
