Notice is hereby given, in accordance with section 23(1)(b) of the Public Works Act 1981, that the Waitakere City Council (“Council”) proposes to take part of the land situated at
14 and 16 Clark Street, New Lynn, Waitakere City,
and more particularly described in the Schedule hereto
(“the land”).
The land is required for roading purposes and it is intended to use the land for the redevelopment and widening of Clark Street, New Lynn, Waitakere City, to cater for future traffic requirements and allow town centre redevelopment.
The reasons why the Council considers it is reasonably necessary to take this interest in the land described in the Schedule are:
(a) to widen the road to cater for the additional traffic volume in Clark Street shortly to result from the termination of State Highway 20 in nearby Maioro Street; and
(b) to facilitate the redevelopment of New Lynn town centre in line with the Council’s approved strategy for the area.
The owner of the land and those persons with a registered interest in it have been served with notice of the Council’s intention to take the land and of their right to object.
Any other person having a right to object to the proposed taking of the said land may forward a written objection
to the Registrar, Environment Court, Department of Courts, Level 8, 3 Kingston Street, Auckland 1010, or to PO Box 7147, Wellesley Street, Auckland 1141, within 20 working days of the date of publication of this notice.
If any objection is made in accordance with this notice. a public hearing will be held.
The objector will have a right to appear and be heard personally unless the objector otherwise requires.
Each objector will be informed of the time and place of the hearing.

(a) 49 square metres; shown as Section 3 on SO 419075, situated at 16 Clark Street, New Lynn, Waitakere City, legally described as Lot 2 DP 67344 comprised and described in Computer Freehold Register NA23A/450.
