Notice of Recommendation for Amendments to the Gas (Downstream Reconciliation) Rules

This notice of a recommendation for amendments to the
Gas (Downstream Reconciliation) Rules 2008 is issued
by Gas Industry Company Limited (“Gas Industry Co”) approved as the industry body by Order in Council under section 43ZL of the Gas Act 1992 (“the Act”).
Section 43O of the Act provides that, no later than 10 working days after making a recommendation for a gas governance regulation to the Minister of Energy, Gas Industry Co must publicise the recommendation.
Recommendation
On 31 July 2009, Gas Industry Co made a recommendation to the Minister of Energy for a number of amendments to the Gas (Downstream Reconciliation) Rules 2008 (“the Rules”).
The effect of the recommended amendments is to:
? alter the scope of some of the Rules to align with current practice or intended best practice to ensure the effective operation of the allocation process for the downstream reconciliation of gas quantities;
? clarify the scope of some of the existing provisions in the Rules;
? promote ease of understanding and interpretation; and
? resolve some minor drafting and wording issues or other minor matters, and provide greater consistency both within the Rules and between the Rules and other gas governance regulations and rules.
Section 43N(3) of the Act provides that Gas Industry Co is not required to comply with section 43N(1) (relating to
an assessment) if it is satisfied that the effect of the recommendation is only minor and will not adversely affect the interests of any person in a substantial way.
Gas Industry Co considers the recommendation satisfies the requirements of section 43N(3) and therefore no assessment under section 43N(1) has been made in respect of the recommendation.
