Radiocommunications Regulations (Prohibited Equipment - Radio Jammer Equipment) Notice 2009

Pursuant to Regulation 32(1)(i) of the Radiocommunications Regulations 2001 ("the Regulations") made under section 134(1)(g) of the Radiocommunications Act 1989 ("the Act"), and acting under delegated authority from the chief executive, I give the following notice.
N o t i c e
1. Short title and commencement-(1) This notice is the Radiocommunications Regulations (Prohibited Equipment - Radio Jammer Equipment) Notice 2009.
(2) This notice comes into force on 13 August 2009.
2. Interpretation-In this notice:
(a) radio jammer equipment means a radio transmitter designed or marketed to cause harmful interference to radiocommunications; and
(b) harmful interference as defined by the Act, means interference which endangers the functioning of a radionavigation service, or other safety services,
or seriously degrades, obstructs, or repeatedly interrupts radiocommunications.
3. Prohibited equipment-The manufacture or sale of radio jammer equipment is prohibited.

Explanatory Note
This note is not part of the notice, but is intended to indicate its general effect.
This notice prescribes that, pursuant to Regulation 32(1)(i) of the Radiocommunications Regulations 2001, the sale or manufacture of radio jammer equipment is prohibited. This notice comes into effect on 13 August 2009.
