Notice of Intention to Make a Recommendation Under Section 82(2) of the Trans-Tasman Mutual Recognition Act 1997

Pursuant to section 75(a) of the Trans-Tasman Mutual Recognition Act 1997 (“the Act”), I give notice of my intention to make the following recommendations to the Governor-General to:
? under section 82(1), by Order in Council, make Regulations extending the exemption period in relation
to provisions specified in Schedule 3 of the Act by
a further 12 months from 1 May 2009; and
? under section 83(1), by Order in Council, make Regulations adding to Schedule 2 of the Act (as a permanent exemption), and excluding from Schedule
3 of the Act, the following provision: the Gas Act 1992 to the extent that it deals with LPG appliances not
tested to operate safely on universal LPG and portable, unflued cabinet heaters that are designed for indoor
use and that operate on LPG using LPG gas cylinders that are self-contained within the heater.
Under sections 82(2) and 83(2), I must not make such recommendations unless I am satisfied that no less than
two-thirds of the participating jurisdictions have endorsed the terms of the proposed Regulations.
