Notice of Entry into Possession of Mortgaged Property and Goods

In the matter of section 156 of the Property Law Act 2007, and in the matter of mortgage instrument 6288542.1 (Gisborne Land Registry) (“the mortgage”) and mortgage of goods dated the 23rd day of December 2004 (“the security agreement”):
FM Custodians Limited (“the mortgagee”), the mortgagee under the mortgage and the secured party under the security agreement, hereby gives notice as follows:
1. On 20 August 2009, the mortgagee under
(a) the mortgage entered into possession of the mortgaged property; and
(b) the security agreement entered into possession
of the mortgaged goods.
2. The description of the mortgaged property is:
(a) Unit 113 and Accessory Unit 46 DP 343280 Identifier 177508 (Gisborne Land Registry), being the property at Unit 113 Portside Apartments,
2 Reads Quay, Gisborne.
(b) Unit 114 DP 343280 Identifier 177509 (Gisborne Land Registry), being the property at Unit 114 Portside Apartments, 2 Reads Quay, Gisborne.
(c) Unit 120 and Accessory Unit 67 DP 343280 Identifier 177515 (Gisborne Land Registry), being the property at Unit 120 Portside Apartments,
2 Reads Quay, Gisborne.
(d) Unit 210 DP 343280 Identifier 177525 (Gisborne Land Registry), being the property at Unit 210 Portside Apartments, 2 Reads Quay, Gisborne.
(e) Unit 301 and Accessory Unit 68 DP 343280 Identifier 177541 (Gisborne Land Registry), being the property at Unit 301 Portside Apartments,
2 Reads Quay, Gisborne.
(f) Unit 303 DP 343280 Identifier 177543 (Gisborne Land Registry), being the property at Unit 303 Portside Apartments, 2 Reads Quay, Gisborne.
(g) Unit 304 and Accessory Unit 69 DP 343280 Identifier 177544 (Gisborne Land Registry), being the property at Unit 304 Portside Apartments,
2 Reads Quay, Gisborne.
3. The description of the mortgaged goods is the furniture, fittings and equipment situated in each of the
above-mentioned units.
4. The address of the mortgagee is care of Auckland Mortgage Trust, Southern Cross Building, corner of High and Victoria Streets, Auckland.
