New Zealand Transport Agency (Maximum Speeds of Vehicles on State Highways)

Amendment Bylaw 2009/14
Pursuant to section 61(3) of the Government Roading Powers Act 1989, and the Land Transport Rule: Setting of Speed Limits 2003, the New Zealand Transport Agency hereby makes the following bylaw.

1. Title and commencement-This bylaw may be cited as the New Zealand Transport Agency (Maximum Speeds of Vehicles on State Highways) Amendment Bylaw 2009/14 and will come into force 28 days after the date of publication of this notice in the New Zealand Gazette.
2. Amendments-The New Zealand Transport Agency (Maximum Speeds of Vehicles on State Highways) Bylaw 2005/7* is hereby amended by:
(a) Replacing the definitions of "variable speed limit" and "variable speed limit sign" in Clause 2, Interpretation with the following definitions:
" "Variable speed limit" has the same meaning as in Land Transport Rule: Setting of Speed Limits 2003.
"Variable speed limit sign" means a sign displaying numerals, which can be changed, to indicate the speed limit in kilometres per hour and complying with the requirements of Land Transport Rule: Traffic Control Devices 2004."
(b) Replacing Clause 4, Variable speeds of vehicles on specified sections of State highways with the following clause:
"Variable speed limits on specified sections of State highway-
(a) The sections of road described in Schedule 1, Part A are subject to a variable speed limit of 50, 60, 70, 80, 90 or 100 kilometres per hour. The speed limit that applies at any time is the speed indicated by the numerals displayed on the variable speed limit signs, except that a blank variable speed limit sign indicates a speed limit of 100 kilometres per hour unless temporary speed limit signs are installed, in which case the temporary speed limit applies. The speed limit is varied to manage the safe and efficient flow of traffic according to the level of traffic congestion; or the weather conditions; or during planned events; or unplanned events.
(b) The sections of road described in Schedule 1, Part B are school zones which are subject to a variable speed limit of 40 kilometres per hour when the numerals "40" are displayed on the variable speed limit signs. At all other times, the speed limit is the permanent speed limit for the road. The variable speed limit signs may indicate a speed limit of 40 kilometres per hourduring the following times on school days:
(i) 35 minutes before the start of school until the start of school;
(ii) 25 minutes at the end of school, commencing no earlier than 10 minutes before the end of school;
(iii) 10 minutes at any other time, when the signs are activated."
(c) Replacing Schedule 1, Part A to read:
"(a) The southbound section of State Highway No. 1
at Wellington, from the Helston Road Overbridge
at Johnsonville, to a point 150 metres south of the southern portal of the Terrace Tunnel. All on-ramps and off-ramps within this section of State highway are included.
(b) The northbound section of State Highway No. 1 at Wellington, from a point 320 metres south of the southern portal of the Terrace Tunnel, to a point
90 metres north of the Helston Road Overbridge at Johnsonville. All on-ramps and off-ramps within this section of State highway are included.
(c) The southbound section of State Highway No. 2 at Wellington, from the gantry located approximately 415 metres north-east of the southern end of
State Highway No. 2, to the southern end of State Highway No. 2 at the Ngauranga Interchange. All on-ramps and off-ramps within this section of State highway are included.
(d) The northbound section of State Highway No. 2 at Wellington, from the southern end of State Highway No. 2 at the Ngauranga Interchange, to the gantry located approximately 400 metres north-east of the southern end of State Highway No. 2. All on-ramps and off-ramps within this section of State highway are included."
(d) Replacing line 443 in Schedule 3 with the following details:
