Notice of Release of Draft Report in Relation to Schedule 3 Investigation Regarding Mobile Termination Access Services

On 6 November 2008, the Commerce Commission
(“the Commission”) gave public notice that it was commencing an investigation (“the investigation”), under Schedule 3 of the Telecommunications Act 2001
(“the Act”), into whether or not the mobile termination access services (incorporating mobile-to-mobile voice termination, fixed-to-mobile voice termination and
short-message-service termination) should become a regulated service under Schedule 1 of the Act.
Under clause 2(1)(a) and (b) of Schedule 3 of the Act, the Commission is required to prepare a draft report and give public notice of the draft report.
On 30 June 2009, the Commission released its draft report on the investigation.
The Commission’s draft recommendation is that the mobile termination access services should be made a designated access service.
The Commission’s draft recommendation is also that the undertakings submitted by Telecom and Vodafone, and
the undertaking submitted by 2degrees, should not be accepted under Schedule 3A of the Act.
Interested parties to the investigation have until 5.00pm on
28 July 2009 to submit on the draft report.
The Commission invites Telecom, Vodafone and 2degrees to submit revised undertakings of Schedule 3A of the Act
by 5.00pm on 28 July 2009.
The Commission will hold a conference on the draft report on 14 and 15 September 2009.
