Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate the
power under section 12(6) of the Submarine Cables and Pipelines Protection Act 1996 to Maritime New Zealand, by an instrument of delegation dated 19 March 1997.
And whereas, pursuant to section 442 of the Maritime Transport Act 1994 and section 73 of the Crown
Entities Act 2004, Maritime New Zealand did delegate
the power under section 12(6) of the Submarine Cables
and Pipelines Protection Act 1996 to the Director of Maritime New Zealand, by an Instrument of Delegation dated 17 January 2008.
Therefore I, Catherine Taylor, Director of Maritime
New Zealand, hereby declare as follows:
The Submarine Cables and Pipelines Protection Order 2009 shall not apply to the following ship:
Seatow 80
in respect of the protected area designated “Area 2 – Hauraki”, when that vessel is anchored in the Hauraki
Gulf off Mairangi Bay at locations approved by
Telecom New Zealand Limited, and when that vessel is being operated in compliance with Construction Execution Procedure 7941-621-057.
This declaration is in effect from 14 April 2009 until 22 May 2009.
