Pursuant to the Receiverships Act 1993
Trustees Executors Limited (“the mortgagee”) is the mortgagee under:
(a) memorandum of mortgage 6934484.4 (North Auckland Land Registry) dated the 5th day of
July 2006, given by MDM HOLDINGS LIMITED (“the mortgagor”) in favour of the mortgagee and affecting the land in Computer Freehold Register NA65D/926, being the property known as 7A,
2 St Martins Lane, Grafton, Auckland;
(b) memorandum of mortgage 7065961.8 (North Auckland Land Registry) dated the 11th day of October 2006, given by the mortgagor in favour
of the mortgagee and affecting the lands in Computer Freehold Registers 224674, 224675
and 246106, together being the property known
as 4B, 4C and 10B, 2 St Martins Lane, Grafton, Auckland;
(c) memorandum of mortgage 7004826.5 (North Auckland Land Registry) dated the 28th day of August 2006, given by the mortgagor in favour
of the mortgagee and affecting the land in Computer Freehold Register 205021, being the property known as 5A, 2 St Martins Lane, Grafton, Auckland; and
(d) memorandum of mortgage 5837047.4 (North Auckland Land Registry) dated the 12th day of December 2003, given by the mortgagor in
favour of the mortgagee and affecting the
lands in Computer Freehold Registers NA137C/654, NA125A/28, NA125A/27, NA125A/26, NA137C/658, NA125A/24, NA125A/23 and NA125A/29, being together the property known
as 6 Glenside Crescent, Grafton, Auckland,
together “the mortgages”.
The mortgagor is in default under the mortgages and the mortgagee is entitled to appoint a receiver of the income from each of the above-named lands or any part of it, upon such default.
The mortgagee has appointed Maree Banks, of Crockers Property Management Limited, to be the receiver of the income of each of the above-named lands with all
the powers conferred upon a receiver in terms of the respective mortgages and by the law.
The receiver shall at all times be the agent of the mortgagor and not of the mortgagee.
