Notice of Appointment of Receivers and Managers
Pursuant to Section 8(1)(a) of the Receiverships Act 1993
We, David Ian Ruscoe and Timothy Wilson Downes, chartered accountants, both of Grant Thornton, Wellington and Auckland respectively, hereby give notice, pursuant
to section 8(1)(a) of the Receiverships Act 1993, that on
18 May 2009, Valad Commercial Management Limited (ACN 101 802 046), acting as trustee for the Valad Property Mezzanine Fund (“the secured party”), under the terms of
a general security deed entered into by the company in favour of the secured party on or about 18 April 2007
(“the security deed”), did appoint us receivers and managers on a joint and several basis of all the undertaking, property, rights and assets of PLAZA TOWERS LIMITED charged by, or subject to a security interest arising under, the security deed, with each and all of the powers conferred to
a receiver and manager under the provisions of the security deed and at law.
