Notice of Resignation, and Appointment of Replacement Receiver of Income
Pursuant to Sections 8 and 11 of the Receiverships Act 1993
Take notice that Shaun Neil Adams has resigned from
the office of receiver of income of the properties of the above-named company at 53 and 55 Hurstmere Road, Takapuna, Auckland, with effect from 8 May 2009.
And take notice that the mortgagee has exercised its power to appoint receivers of income of the company and appointed Simon John Francis Peacocke, chartered accountant of BDO Spicers Auckland, to be a joint and several receiver of income of the properties of the company at 53 and 55 Hurstmere Road, Takapuna, Auckland, being more particularly described in Computer Freehold Registers NA186/46 and NA15D/1098 (North Auckland Land Registry) (“the property”) and all rights attaching to the property and to exercise all other powers which a receiver
of income may exercise under the mortgage, under any of the facility terms (as defined in the mortgage) or by the Receiverships Act 1993 from 8 May 2009.
The appointment of Simon John Francis Peacocke is in addition to the existing and continuing appointment of Brian Mayo-Smith, chartered accountant of BDO Spicers Auckland, and is in place of the appointment of Shaun Neil Adams who has, as above, vacated office as receiver of income of the company.
