Notice of Appointment of Receiver of Income
Pursuant to Section 8(1)(b) of the Receiverships Act 1993
ANZ National Bank Limited (“the mortgagee”) is the mortgagee under mortgage 7513628.2 (Otago Land Registry) registered on 27 August 2007 (“the mortgage”)
given by POUNAMU TRUSTEES TWO LIMITED
(“the mortgagor”) in favour of the mortgagee and affecting Computer Freehold Registers 238475, 238479 and 238483, being the properties known as Units 8, 12 and 16 Pounamu,
96 Frankton Road, Queenstown (“the land”).
The mortgagor is in default under the mortgages and the mortgagee is entitled to appoint a receiver of the income from the land or any part of it, upon such default.
The mortgagee appointed Ian Gerrard McLauchlan, solicitor of Lower Hutt, on 2 April 2009, to be the receiver of the income of the land with all the powers conferred upon
the receiver of the income in terms of the mortgage and
by the law.
The receiver of the income shall at all times be the agent
of the mortgagor and not of the mortgagee.
