Notice of Appointment of Receiver of Income
Pursuant to Section 8(1)(b) of the Receiverships Act 1993
Foundation Custodians Limited (“the mortgagee”) is the mortgagee under memorandum of mortgage 7417750.2 (South Auckland Land Registry) registered on 15 June
2007 (“the mortgage”) given by VICTOR CALITZ
(“the mortgagor”) in favour of the mortgagee and
affecting the land in Computer Freehold Register SA1748/34 (South Auckland Land Registry) being the property known as 31 Jones Crescent, Hamilton
The mortgagor is in default under the mortgage and the mortgagee is entitled to appoint a receiver of the income from the land or any part of it, upon such default.
The mortgagee appointed David William Wallace, solicitor of Lower Hutt, on 25 February 2009, to be the receiver of the income of the land with all the powers conferred
upon the receiver of the income in terms of the mortgage and by the law.
The receiver of the income shall at all times be the agent of the mortgagor and not of the mortgagee.
