Notice of Appointment of Liquidators
The Charitable Trusts Act 1957
Notice is hereby given that on 7 May 2009 at 10.30am,
it was resolved by special resolution of shareholders, pursuant to section 24(2) of the Charitable Trusts Act
1957, that BAY FOUNDATION be liquidated and that Stephen Mark Lawrence and Anthony John McCullagh, insolvency practitioners of PKF Corporate Recovery
& Insolvency (Auckland) Limited, be appointed joint and several liquidators for that purpose.
Notice to Creditors to Prove Debts or Claims
Notice is given that the liquidators have fixed 12 June
2009, as the day on or before which the creditors of the above-named charitable trust are to make their claims and to establish any priority their claims may have, under section 312 of the Companies Act 1993, or to be excluded from the benefit of any distribution made before the claims are made or, as the case may be, from objecting to the distribution.
