way. The applicant claims the right of way is redundant by reason of the circumstances set out below. I intend to remove the right of way on 18 July 2008 if no objections have been received before that date.

Easement: Right of way over Lot 1 on DP 9102; marked “A” and “B” on DP 9102 (comprised in Computer Freehold Register MB5B/972), as appurtenant to Lot 1 DP 9360 (comprised in Computer Freehold Register MB5C/253), created by easement certificate 173502.3 registered on 14 April 1994.
Circumstances: Part of the dominant land being Lot 1 DP 9360 has become physically separated from the servient land as
a result of subdivision in DP 9360.
