The applicants described below have applied, under section 70 of the Land Transfer Act 1952 for the removal of a limited right of way. The applicants claim the limited right of way is redundant by reason of the circumstances set out below. I intend to remove the limited right of way on 13 June 2008 if no objections have been received before that date.
Application: 7759950.1.
Applicants: James Edward Bowden and Victoria Mary Bowden, c/o Wynn Williams, Solicitors, Level 7, BNZ House, 129 Hereford Street, Christchurch.
Easement: Limited right of way over Lot 2 DP 22183 coloured yellow on DP 22183 comprised in Computer Freehold Register CB1D/1292 created by transfer 589335 registered on 12 November 1962 and varied by instrument 41544.2.
Circumstances: The easement is determined due to John Alexander Howden and Ngaire Wright no longer occupying Lot 1 DP 22183 as required under Variation of Easement 41544.2 and that half the cost of forming and metalling a new entrance to the dwelling house on Lot 1 DP 22183 has been paid.
Dated at the Hamilton Office of Land Information New Zealand this 8th day of May 2008.
M. COLE, for Registrar-General of Land.
