Notice Pursuant to Section 70 of the Land Transfer Act 1952

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a easement in gross. The applicant claims the easement is redundant by reason of the circumstances set out below. I intend to remove the easement on 12 May 2008 if no objections have been received before that date.

Applicant: Waimauku Estate Limited, c/o Hornabrook Macdonald, Lawyers, PO Box 91845, Auckland 1010.
Easement: Right of way over part marked on DP 2207 created by deed of conveyance (118140 R36/900) dated 5 November 1890 affecting part Lots 3 and 4 DP 202906 comprised in Computer Freehold Register NA128D/213.
Circumstances: The easement was originally reserved in favour of Paora Tuhaere (deceased) and is not registered as appurtenant to any land. The easement no longer benefits the grantee in gross.
