Notice of Intention to Take Land for Road—Wairau Road, North Shore City, North Auckland Land District

Notice is hereby given that the North Shore City Council (“the council”), under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule hereto (“the land”).
The land described in the Schedule to this notice is required for road widening purposes.
The intended taking is considered reasonably necessary for the safe, effective and convenient use of Wairau Road.
It will provide for increased and altered traffic flows and will provide better access facilities for buses, cyclists
and pedestrians.
This use of the land is in accordance with Designation 183 of the council’s district plan.
The owners of the land and those persons with a registered interest in it have been served with notice of the council’s intention to take their land and advised of their right to object.
Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Ministry of Justice, PO Box 5027, Lambton Quay, Wellington 6145, within 20 working days after the date of publication of this notice.
If any objection is made in accordance with this notice, a public hearing will be held with the right of the objector to appear and be heard personally unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Schedule
Land proposed to be taken:
(a) The fee simple interest in 120 square metres being Section 2 SO 405170, part Lot 60 DP 8798 and part of the land described in Computer Freehold Register NA400/86; and
(b) The interest of the mortgagee ASB Bank Limited through mortgage D368529.2 by Barry Thomas Taylor and Joia Camarina Taylor.
