Land Acquired for Scenic Reserve and Right of Way-Chatham Islands

Pursuant to section 20(1) of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into:
(a) The land described in the First Schedule to this notice is acquired for scenic reserve purposes and shall vest in the Crown;
(b) An easement for a pedestrian right of way is acquired for scenic reserve purposes over the land in the Second Schedule to this notice, which shall be subject to the terms and conditions in the Third Schedule to this notice and shall vest in the Crown. This easement is to be forever appurtenant to the land in the First Schedule and may be surrendered at any time by notice in the New Zealand Gazette

Third Schedule
Terms and Conditions of Right of Way
1. This Schedule is subject to the provisions in the Seventh Schedule of the Land Transfer Act 1952, and the
Fifth Schedule of the Property Law Act 2007, except as modified as follows:
2. The use of the right of way is open to the Crown,
Her servants, agents and workmen and members of the public who shall have full, free and uninterrupted and unrestricted rights from time to time and at all times at their will and pleasure, to go, pass and repass over and along the right of way;
3. the right of the public under clause 2 is restricted to foot access only; and
4. the Crown shall be responsible for the maintenance of the right of way.
