Pursuant to Regulation 41 of the Fisheries (Reporting) Regulations 2001, the Manager Regulatory and Information of the Ministry of Fisheries, acting pursuant to a delegation from the Chief Executive of the Ministry of Fisheries under the State Sector Act 1988, gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice may be cited as the Fisheries (Rock Lobster Reporting Waiver) Notice 2008.
(2) This notice shall come into effect on 1 October 2008.
2. Interpretation—In this notice:
(a) “person” means a permit holder, or any person authorised by the permit holder to complete a Catch, Effort and Landing Return (CELR);
(b) “rock lobster” means a crustacean of the species Jasus edwardsii (also known as red rock lobster, spiny rock lobster or koura); and Sagmariasus verreauxi (also known as packhorse rock lobster, green rock lobster, Jasus verreauxi, or pawharu); and includes any part of those fish;
(c) “rock lobsters in non-legal states” means any rock lobster:
(i) carrying external eggs;
(ii) in the soft-shell stage;
(iii) where the calcified bar or a part of the exoskeleton (the outer shell of the tail) of
the first abdominal segment of the tail is fractured;
(iv) in such a state that its tail cannot be properly measured in the manner required under regulations made under section 297 of the Fisheries Act 1996; or
(v) where the calcified bar or a part of the exoskeleton (the outer shell of the tail) of
the second abdominal segment of the tail is fractured or a part of a primary pleural spine of the second abdominal segment is broken.
3. Rock lobster reporting waiver—(1) A person who is required to provide a completed CELR for rock lobster fishing need not complete information for rock lobsters in non-legal states in respect of any returns to the sea properly made in accordance with Schedule 6 of the Fisheries Act 1996. Specifically the requirement to provide in these circumstances:
(a) estimated greenweight (“Weight (kg)”) information in the Catch/Effort data section of the CELR; and
(b) estimated landing information recorded to destination type code “X” in the Catch Landing data section of the CELR
is waived.
(2) This reporting waiver does not apply to any other CELR destination type code.
4. Application—This reporting waiver will apply until further notice.
