Fisheries (Declaration of Mataitai Reserve at Mt Maunganui and Part of Tauranga Harbour and Appointment of Tangata Kaitiaki/Tiaki) Notice 2008 (No. F456)

Pursuant to Regulations 23, 24 and 25 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Minister of Fisheries gives the following notice.
N o t i c e
1. Title-This notice is the Fisheries (Declaration of Mataitai Reserve at Mt Maunganui and Part of Tauranga Harbour and Appointment of Tangata Kaitiaki/Tiaki) Notice 2008.
2. Commencement-This notice shall come into effect on the 28th day after the date of its notification in the
New Zealand Gazette.
3. Interpretation-In this notice:
(a) "mataitai reserve" means the identified traditional fishing ground described in clause 4 of this notice; and
(b) "Tangata Kaitiaki/Tiaki" means any person or persons appointed as Tangata Kaitiaki/Tiaki for the mataitai reserve under Regulation 24 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
4. Declaration of a mataitai reserve-The Minister of Fisheries hereby declares a mataitai reserve at Mt Maunganui, encompassing all of the coastal waters enclosed by a line that:
(a) commences at a point at the mean high water springs on the coastline at 37ø38.84'S and 176ø12.00'E; then
(b) proceeds due north to a point at 37ø37.30'S and 176ø12.00'E; then
(c) proceeds due west to a point at 37ø37.30'S and 176ø09.80'E; then
(d) proceeds south to "B" Buoy at 37ø37.42'S and 176ø09.78'E; then
(e) proceeds south to light "No.2 Reach Ldg Lts Front" at 37ø38.87'S and 176ø09.82'E; then
(f) proceeds due south to light "No.2 Reach Ldg Lts Rear" at 37ø39.28'S and 176ø09.82'E; then
(g) proceeds east to channel marker "Otumoetai 1" at 37ø39.30'S and 176ø10.54'E; then
(h) proceeds north-east to channel marker No. 17 at 37ø39.24'S and 176ø10.68'E; then
(i) proceeds north to channel marker No. 15 at 37ø39.07'S and 176ø10.75'E; then
(j) proceeds north to channel marker No. 13 at 37ø38.94'S and 176ø10.76'E; then
(k) proceeds north to channel marker No. 11 at 37ø38.81'S and 176ø10.74'E; then
(l) proceeds north to channel marker C5 at 37ø38.68'S and 176ø10.68'E; then
(m) proceeds north-west to channel marker C3 at 37ø38.55'S and 176ø10.52'E; then
(n) proceeds north-west to channel marker C1 at 37ø38.45'S and 176ø10.33'E; then
(o) proceeds north-west to "Stoney Point" Light (Tangaroa monument) at 37ø38.21'S and 176ø10.12'E; then
(p) proceeds due north to a point at the mean high water springs on the coastline at 37ø38.15'S and 176ø10.12'E; then
(q) proceeds around the coastline of Mt Maunganui along the mean high water springs to the point of commencement.
5. Appointment of Tangata Kaitiaki/Tiaki-Patrick Nicholas, Erica Rolleston, Tu Piahana, Rehua Smallman, Paul Borell and Penetaka Dickson are hereby appointed as Tangata Kaitiaki/Tiaki for the above mataitai reserve.
6. Commercial fishing prohibited area-Commercial fishing within the above mataitai reserve is prohibited under Regulation 27 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
7. Power to authorise taking of fisheries resources for customary food gathering-The Tangata Kaitiaki/Tiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996 for customary food gathering purposes from within the whole or any part of the mataitai reserve. No customary fishing may take place in
the mataitai reserve without authorisation from the Tangata Kaitiaki/Tiaki.
