1. Pursuant to section 43R of the Gas Act 1992
(“Act”), I notify the making of the Gas (Processing Facilities Information Disclosure) Rules 2008 (“Rules”) under section 43Q of the Act.
2. The empowering provision for the gas governance regulation in relation to which the Rules are made is section 43G(2)(l).
3. The purpose of the Rules is to provide a process to settle the issue of whether it is necessary to recommend rules or regulations setting reasonable terms and conditions for access to, and use of, gas processing facilities.
The Rules:
(a) require the owners of gas processing facilities to disclose to Gas Industry Company Limited information about their facilities including technical capabilities and availability of spare capacity;
(b) set out obligations with respect to public disclosure of that information by Gas Industry Company Limited;
(c) require the owners of gas processing facilities to disclose to Gas Industry Company Limited the number of bona fide third party approaches regarding access; and
(d) oblige Gas Industry Company Limited to report to the Minister of Energy on the need for further regulation of access to gas processing facilities after a period of five years.
