Fisheries (Kaimoana Customary Fishing) Notice (No. 4) 2008 (No. F439)

Pursuant to Regulations 9 and 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Programme Manager (Deed of Settlement Implementation Programme) at the Ministry of Fisheries (acting pursuant to a delegated authority in accordance with section 41 of the State Sector Act 1988) gives the following notice.

1. Title and commencement—(1) This notice may be
cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 4) 2008.
(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.
2. Interpretation—In this notice:
(a) “mahinga mataitai” are local dialect words that have the same meaning as “customary food gathering”,
a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998;
(b) “Kaitiaki” is a local dialect word that has the same meaning as “Tangata Kaitiaki/Tiaki”, a term that is defined in Regulation 2 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998.
(c) “Kaitiaki” means the person or persons appointed under Regulation 9 or 10 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 for the management of mahinga mataitai within
the area/rohe moana.
(d) “area/rohe moana” means all that area of waters enclosed by a line commencing:
(i) at a point on the coastline at Paritu (38°57.0'S 177°54.2'E);
(ii) then due east for 200 nautical miles to a point (38°57.0'S 177°25.0'W);
(iii) then due south to a point (43°15.0'S 177°25.0'W);
(iv) then 45° north-west to a point (39°18.6'S 177°45.0'E);
(v) then due north to a point (39°13.3'S 177°44.9'E);
(vi) then generally north-easterly to a point on
the coastline at Waikokopu (39°04.4'S 177°49.6'E);
(vii) then generally northerly along the mean
high-water springs mark to the point of commencement.
The geographical coordinates named are in terms of the WGS84 datum.
3. Request to cancel appointment—The Mahia Maori Committee, acting for the tangata whenua who nominated Moana Kim Whaanga as a Kaitiaki for the area/rohe moana, has requested in writing the cancellation of his appointment as a Kaitiaki.
4. Cancellation of appointment—On 4 March 2008, the Associate Minister of Fisheries, under Regulation 10(1) of
the Fisheries (Kaimoana Customary Fishing) Regulations 1998, cancelled the appointment of the late Moana Kim Whaanga as a Kaitiaki for managing mahinga mataitai within the area/rohe moana.
5. Nomination of Kaitiaki—The Mahia Maori Committee, acting for the whanau, hapu and marae of Rongomaiwahine, has nominated Pera Edwards as an additional Kaitiaki and Tohu Kereru as a replacement Kaitiaki for managing mahinga mataitai within the area/rohe moana.
6. Appointment of Tangata Kaitiaki—On 4 March 2008, the Associate Minister of Fisheries, under Regulations 9(1) and 10(2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 respectively, confirmed the appointment
of Pera Edwards and Tohu Kereru as an additional and a replacement Kaitiaki respectively for managing mahinga mataitai within the area/rohe moana.
7. Power to authorise the taking of fisheries resources for mahinga mataitai—A Tangata Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Act 1996, other than those resources that are taken in fresh water, for mahinga mataitai purposes from within the whole or any part of the area/rohe moana. No mahinga mataitai of fisheries resources may take place in the area/rohe moana without an authorisation from a Tangata Kaitiaki.
