1. In Decisions 384, 517 and 547, the Commerce Commission (“Commission”), pursuant to section 81(1)
of the Electricity Industry Reform Act 1998 (“EIR Act”), exempted Joan Withers1, Dr Keith Turner2 and Wayne Boyd3 from the application of section 17 of the EIR Act in relation to a prohibited cross-involvement in an electricity supply business (Meridian Energy Limited) and an electricity lines business (Auckland International Airport Limited). These exemptions were subject to a condition that Meridian Energy Limited not enter into any kind of contract or arrangement with Auckland International Airport Limited that related to the use of Auckland International Airport Limited’s electricity distribution network whilst the exempt persons remained cross-involved.
2. Joan Withers, Dr Keith Turner and Wayne Boyd
have now confirmed that these cross-involvements
no longer exist and the exemptions are no longer required. Meridian Energy Limited requests that it be released from its restrictions on operating on Auckland International Airport Limited’s electricity network.
3. The Commission, pursuant to section 81(5) of the Electricity Industry Reform Act 1998, revokes
the exemptions granted to Joan Withers, Dr Keith
Turner and Wayne Boyd in Decisions 384, 517 and 547 (respectively).
4. The revocation takes effect from the date of publication of this notice in the New Zealand Gazette.
Dated this 19th day of September 2008.
PAULA REBSTOCK, Chair, Commerce Commission.
