Notice of Recommendation Concerning the Proposed Electricity Governance (Security of Supply) Regulations 2008

1. This notice of a recommendation concerning the proposed Electricity Governance (Security of Supply) Regulations 2008 is issued by the Electricity Commission (“Commission”) pursuant to section 172E(2)(c) of the Electricity Act 1992 (“Act”).
Recommended Regulations
2. On 26 June 2008, the Commission recommended to the Minister of Energy that the Electricity Governance (Security of Supply) Regulations 2008 be made.
3. The purpose of the Regulations is to provide for the management and coordination of outages for security of electricity supply purposes.
4. The Commission has recommended that these Regulations be made under urgency in reliance on section 172E(3) of the Act.
Section 172E(3) of the Act provides that sections 172E(2)(b) and 172F (which relate to consultation and assessment) do not apply if the Commission considers that it is necessary or desirable in the public interest that the recommended Regulations be made urgently.
Instead, consultation and an assessment must be carried out within six months of the Regulations being made.
