Electricity Governance Regulations (Exemption No. 48 (Electricity Ashburton Limited and Orion New Zealand Limited)) Exemption Notice 2008

Pursuant to Regulation 194(2) of the Electricity
Governance Regulations 2003, the Electricity Commission (“Commission”) gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice is the Electricity Governance Regulations (Exemption No. 48 (Electricity Ashburton Limited and Orion New Zealand Limited)) Exemption Notice 2008.
(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.
2. Exemption—(1) Electricity Ashburton Limited (“EAL”) is exempted from compliance with the following Electricity Governance Rules 2003 (“Rules”):
Until 30 April 2008:
(a) Rule 3.5 of Part D; and
(b) Rule 4 of Code of Practice G1 of Schedule G8 of Part G;
From 1 May 2008:
(a) Rule 3.7 of Part D; and
(b) Rule 19 of Part J.
(2) Orion New Zealand Limited (“Orion”) is exempted from compliance with the following Rules:
Until 30 April 2008:
(a) Rule 5.5.2 of Section VI of Part G;
From 1 May 2008:
(a) Rule 4.3.2 of Part J.
3. Terms and conditions—This exemption is granted on the following conditions:
(a) It shall only apply to:
(i) the EAL embedded network connected to NSP URK0111; and
(ii) the Orion embedded network connected via EAL embedded network connected to NSP URK0111; and
(b) the exemption will expire on 30 May 2013.
4. Reasons for granting the exemption—The reasons for granting this exemption are:
(a) without an exemption, Orion and EAL would incur significant expenditure and complexity in the fitting of metering and communication equipment to its networks for relatively low consumption volumes;
(b) the historical nature of the connections and impracticability of connecting strictly in accordance with the Rules;
(c) EAL and Orion have proposed a materially accurate method to calculate consumption for settlement; and
(d) there will be little or no impact on other participants and service providers and the proposed exemption would not affect any other rules.
