Notice of Appointment of Receivers and Managers
Pursuant to Section 8(1)(b) of the Receiverships Act 1993
On 14 November 2008, we, Timothy Wilson Downes, of Auckland, and Richard Grant Simpson, of Wellington, both chartered accountants, were appointed receivers and managers of the property of Auckland Luge Limited (“the company”) in respect of all the right, title and interest (present and future, legal and equitable) in the undertaking, property, assets and revenues of the company with power to manage the company’s business and to exercise all other powers which a receiver may exercise under the general security agreement, or by law.
The appointment was effected pursuant to the rights and powers conferred by a general security agreement dated the 2nd day of August 2007 registered under the Personal Property Securities Act 1999 on 19 September 2007 as Financing Statement F30C97T70VX20D57.
