Pursuant to clause 5(1) of Schedule 2 of the Local Government Act 2002, the Minister of Local Government gives the following notice.
N o t i c e
1. Title and commencement—This notice is the Local Government (Franklin District) Boundary Alteration Notice 2007.
(2) This notice comes into force on the day after it is published in the New Zealand Gazette.
2. Boundaries of Franklin District—The seaward boundaries of the following parts of Franklin District are extended to the mean low water springs:
(a) That part of the district adjacent to the Manukau Harbour or any river, stream or creek flowing into the Manukau Harbour; and
(b) That part of the district adjacent to the Tasman Sea situated between the Waikato River and the southern boundary of the district.
3. Application to existing boundaries—Nothing in this notice has the effect of excluding from Franklin District any area included in that district before this notice came into force.
4. Wards—The areas included in Franklin District by this notice are included in the adjacent ward of Franklin District.
5. Communities—The areas included in Franklin District by this notice and which are adjacent to the Onewhero-Tuakau Community or the Waiuku-Awhitu Community are included in the community to which they are adjacent.
6. Boundaries of adjacent territorial authority districts—Unless the circumstances otherwise require, wherever the boundaries of Franklin District meet the boundary of another territorial authority district at the mean high water mark, the boundary of the Franklin District extends from that point along a line running at 90 degrees from the line of the mean high water mark to the point where the boundary meets the line of the mean low water springs.
