Modification of a Designation of an Auditing Agency

Pursuant to section 35 of the Health and Disability Services (Safety) Act 2001 ("the Act"), I, Stephen McKernan, the Director-General of Health, amend Telarc Limited's designation by replacing the words "Telarc Limited" with the words "Telarc SAI Limited (trading as Quality Health New Zealand)" wherever they appear in the designation.
The designation as amended by this modification notice is set out below:
"Designation of Auditing Agency
Pursuant to section 32 of the Health and Disability Services (Safety) Act 2001 ("the Act"), the Director-General of Health designates Telarc SAI Limited (trading as Quality Health New Zealand) ("the auditing agency") to audit the provision or likely future provision of the following kinds of health care services:
- Hospital Care (as defined in section 4(1) of the Act)
- Rest Home Care (as defined in section 6(2) of the Act)
- Residential Disability Care (as defined in section
4(1) of the Act)
This designation is subject to the following conditions:
1. The auditing agency must ensure that where it
audits the provision of health care services for people with physical or sensory disabilities, or intellectual disabilities, or psychiatric disabilities or mental illnesses, the auditing agency observes the following:
- For audits involving services for people with physical or sensory disabilities, a person with a pronounced physical or sensory disability, must fully participate in all aspects of the audit.
- For audits involving services for people with intellectual disabilities, a person with an intellectual disability (accompanied by a support person where necessary), or a close family or whanau member
of a person with an intellectual disability must participate in all aspects of the audit.
- For people with psychiatric disabilities or mental illnesses, a past or present consumer of
mental health services must fully participate in
all aspects of the audit.
2. The auditing agency is required to conduct health and disability focused audits, together with a compliance audit against the requirements of the Health and Disability Services (Safety) Act 2001 annually.
3. The auditing agency is required to conduct health
and disability services sector focused management reviews annually.
4. The auditing agency is required to provide written details of its internal appeals process to all clients.
This notice, which expires on 2 August 2008, revokes in its entirety the notice that designated Telarc Limited pursuant to section 32 of the Health and Disability Services (Safety) Act 2001, published in the New Zealand Gazette, 21 September 2006, No. 109, page 3242."
