Pursuant to section 60 of the Fisheries Act 1996, the Minister of Fisheries, after consultation with representative organisations that have an interest in section 60, and after consideration of the matters specified in section 60(3) of the Fisheries Act 1996, hereby gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice 2007 (No. F401).
(2) This notice shall come into effect on the day after its notification in the New Zealand Gazette.
2. Exemption to quota aggregation limit for deepwater clam—From the date that this notice comes into effect
and for a period of five years after that date, consent is given for Westhaven Shellfish Limited to hold quota shares for deepwater clam having a combined quota weight less
than or equal to 58.67% of the combined total allowable commercial catches of deepwater clam.
3. Exemption to quota aggregation limit for knobbed whelk—From the date that this notice comes into effect, consent is given for Westhaven Shellfish Limited to hold quota shares for knobbed whelk having a combined quota weight equivalent less than or equal to 37.31% of the combined total allowable commercial catches of knobbed whelk.
4. Avoidance of doubt—For the avoidance of doubt, at
the conclusion of the period of five years referred to in clause 2 of this notice, the quota aggregation limit for Westhaven Shellfish Limited for deepwater clam reverts to the aggregation limit of the total allowable commercial catches of deepwater clam specified in the Fifth Schedule
of the Fisheries Act 1996.
