Notice of Approval of a Scheme

In the matter of the Charitable Trusts Act 1957, and in the matter of the estate of Margaret Grace Ferguson, and in the matter of an application pursuant to the said
Act in relation to the said estate, between Rodney Jonathan Smith, account manager of Wellington, in the capacity as the executor of the said estate, applicant:
Take notice that:
The applicant has commenced proceedings in the High Court at Wellington for an order pursuant to the Charitable Trusts Act 1957, sanctioning a scheme in connection with a bequest made by the late Margaret Grace Ferguson by
her will dated 3 June 1986 as amended by codicil dated
the 16th day of May 1994 to “Wesley Ewart Hospital”, the bequest having failed because Wesley Ewart Hospital ceased to exist prior to the late Margaret Grace Ferguson’s death on 11 September 2003.
The scheme consists of a proposal that the residue of the late Margaret Grace Ferguson’s estate be paid to Wesley Wellington Mission Incorporated for the use and benefit of patients of that incorporated charity’s Wesleyhaven home in Naenae.
The applicant’s originating application is set down to be heard in the High Court at Wellington on 25 September 2007 at 10.00am.
Any person desiring to oppose the scheme is required to give written notice of their intention to do so to:
(a) the Registrar of the High Court at Wellington;
(b) the applicant, whose address for service at the office of Macalister Mazengarb, Solicitors, Level 7,
Laptop House, 23 Waring Taylor Street, Wellington (Attention: Suzanne Griffin); and
(c) the Attorney-General, whose address for service
at the Crown Law Office, Unisys House, 56 The Terrace, Wellington (Attention: Rachael Schmidt).
