I, John Norman Keith Mansell, General Manager Maritime Operations, Maritime New Zealand, being satisfied that the granting of this exemption will not breach New Zealand's international obligations, and pursuant to sections 47(2)(b)(iii), 47(2)(b)(iv) and 47(2)(c) of the Maritime Transport Act 1994, acting under delegated authority hereby give notice
as follows:
The owner and master of M/V Kakariki (IMO 9158305) is exempt from the requirement in Maritime Rule 40B.23(1)(c) in relation to Regulation 10.1.2 of chapter IV of SOLAS convention, which states - "an MF radio installation capable of transmitting and receiving for distress and safety purposes, on frequencies:
.2.1 2,187.5 kHz using DSC; and
.2.2 2,182 kHz using radiotelephony",
subject to the following conditions:
1. The M/V Kakariki remains within 200 nautical miles of the coast of New Zealand's North and South Islands;
2. all other requirements of Regulation 10 of Chapter IV of SOLAS shall be met in full; and
3. actions must be taken to ensure the ship complies with Maritime Rule 40B.23(1)(c) at the owner's earliest convenience and not later than 10 August 2007.
The exemption from the provisions of Maritime Rule 40B.23(1)(c) shall remain in force until:
(a) one or more of the above conditions is not met;
(b) the ship undergoes major alteration or its operating limits are permanently changed;
(c) the ownership of the ship is changed;
(d) the exemption is revoked by the Director of Maritime New Zealand; or
(e) the expiry date;
whichever occurs first.
This exemption shall expire at 00:00* on 1 October 2007.
