Land Transfer Act Notice

The applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of a right of way and a right to convey water. The applicants claim the right of way and the right to convey water is redundant by reason
of the circumstances set out below. I intend to remove the easement on the 8th day of December 2006, if no objections have been received before that date.

Applicants: Arthur Lawrence Balck and Pamela Vera Balck, care of D. Earle, Glasgow Harley, P.O. Box 138, Nelson.
Easement: Right of way over part Section 22, Square 12, a right to convey water over parts marked “C”, “D” and “E” on DP 14967; a right of way over Lot 3, DP 13975, marked “A” on DP 16078; a right of way over Lot 2, DP 9237, marked “B” on DP 16078; a right of way over Lot 1, DP 16652, marked “B” and “C” on DP 16652; a right of way over parts marked “H” “K” and “N” on DP 316070; and a right of way over parts marked “A” “B” “C” “D” and “E” on DP 17079, all appurtenant to Lot 8, DP 316070.
Circumstances: Due to the separation of the dominant tenement from the servient tenement caused by numerous subdivisions.
