Land Transfer Act Notice

The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the partial removal of an easement. The applicant claims the easement is redundant by reason of the circumstances set out below. I intend to partially remove the easement on the 30th day of November 2006, if no objections have been received before that date.

Description of Easement: Right to drain water over part marked “F”, DP 17710 (Section 1, SO 9952), comprised in Computer Freehold Register HBV1/166, created by transfer 474613.6, registered on the 30th day of March 1987.
Circumstances: Some of the dominant tenements (now Lot 1, DP 350719, Computer Freehold Register 207639); (now Lot 2, DP 350719, Computer Freehold Register 207640); (now Lot 7, DP 350719, Computer Freehold Register 207645); (now Lot 8 DP 350719 Computer Freehold Register 207646); (now Lot 9 DP 350719 Computer Freehold Register 207647); (now Lot 10, DP 350719, Computer Freehold Register 207648); (now Lot 11, DP 350719, Computer Freehold Register 207649); (now Lot 12, DP 350719, Computer Freehold Register 207650); (now Lot 13, DP 350719, Computer Freehold Register 207651); (now Lot 14, DP 350719, Computer Freehold Register 207652); have become physically separated from the servient tenement as a result of subdivision and no longer benefit these dominant lands.
