The applicant claims the easement is redundant by reason of the circumstances set out below. Easement: Right of way over part Lot 4; marked “K” on DP 324751, comprised in Computer Freehold Register 99827 and part Lot 2; marked “B” on DP 175624, now Lot 100, DP 181628, legal road specified in easement certificate D084509.30, registered on the 24th day of December 1996.
Circumstances: Part of the dominant tenement has become physically separated from the servient tenement as a result of subdivision and other relevant issues, and part of the servient tenement has become road.
