Acquisition of Land for Recreation Ground—Kuratau, Taupo District

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, Stephen Robert Gilbert, Land Information
New Zealand, declares that, an agreement to that effect having been entered into:
(a) The land described in the First Schedule is hereby acquired for recreation ground to be known as Whiowhio Reserve and vested in the Taupo District Council on the date of publication of this notice in the New Zealand Gazette, subject to Proclamation published in the New Zealand Gazette, 8 October 1926, No. 69, page 2895 (Document PROC.1716) and to amending Proclamation published in the New Zealand Gazette, 25 November 1999, No. 177, page 4242 (Document B758623.1) and, subject to the conditions stipulated in the Second Schedule.
(b) The land described in the Third Schedule is to be subject to a land covenant on the terms set out in the Fourth Schedule the benefit of which is to be annexed to the land described in the First Schedule on the date of publication of this notice in the New Zealand Gazette.

First Schedule

3.1584 Part Pukawa D1 Block; shown as Section 1 on SO 364294 (part Computer Freehold Register WN46C/692).
Second Schedule
Conditions applying to land in the First Schedule:
1. As a recreation ground the land will not be used for camping or temporary accommodation or any residential, commercial or industrial purpose.
2. No building (as defined by section 8 of the Building Act 2004 but including a NUO system), will be permitted within or on that part of the land shown marked “A” on SO 364294.
3. No motor vehicle, motorcycle or power cycle shall
be permitted in or on that part of the land shown
marked “A” on SO 364294, but this prohibition shall
not apply to any motor vehicle engaged in work
lawfully authorised by the Taupo District Council
(or any successor local authority).
Third Schedule
All that parcel of land being Part Pukawa D1 Block;
marked “B” on SO 364294 (part Computer Freehold Register WN46C/692).
Fourth Schedule
Terms of Land Covenant
The owner or owners for the time being of the land described in the Third Schedule shall at all times:
(a) Not permit any building (as defined by section 8 of the Building Act 2004 but including a NUO system) to be constructed on the land.
(b) Preserve the natural environment and landscape amenity of the land by using it only for the purpose of the growing of plants, trees and shrubs.
