Fisheries (Te Waewae Bay Amateur Set Netting Restriction) Notice 2006 (No. F390)

Pursuant to section 11 (4) (b) (i) of the Fisheries Act 1996, the Minister of Fisheries hereby gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice may be cited as the Fisheries (Te Waewae Bay Amateur Set Netting Restriction) Notice 2006.
(2) This notice shall come into effect on the day after the date of its notification in the New Zealand Gazette.
2. Interpretation—In this notice:
(a) “set net” includes a gill net, or any other sort of net which acts by enmeshing, entrapping or entangling any fish.
(b) “Te Waewae Bay” encompasses all those waters that lie within straight line from Sand Hill Point (a point approximately 46°15.01'S and 167°19.08'E); then proceeding in a generally easterly direction to Pahia Point (a point approximately 46°19.24'S and 167°41.23'E); then proceeding along the line of mean high water excluding all rivers and estuaries to the point of commencement.
3. Restriction on amateur set netting in Te Waewae Bay South Island—Any person using or setting any set net in
Te Waewae Bay must remain in the immediate vicinity of that net while it is set.
This Gazette Notice does not apply to any person taking any fish, aquatic life or seaweed while acting under the authority of and in accordance with a current fishing permit.
