Training Incentive Allowance Amendment (No 2) 2006

Pursuant to section 124 (1) (d) of the Social Security Act 1964, the Minister for Social Development and Employment makes the following amendment to the Training Incentive Allowance Programme* (as established and approved on
30 November 1998).

A m e n d m e n t
1. Title-This amendment is the Training Incentive Allowance Amendment (No 2) 2006.
2. Commencement-This amendment comes into effect on 1 January 2007.
3. Programme amended-This amendment amends the Training Incentive Allowance Programme.
4. Allowances-Clause 5 of the programme is amended:
(a) by revoking paragraph (b) of subclause 5.1.1 and substituting the following paragraph:
"(b) is enrolled (or is enrolled subject to the payment of tuition fees) in an employment-related training course-
(i) for which the course provider receives funding under section 159ZC of the Education Act 1989; or
(ii) for which the course provider receives other government funding that the chief executive considers is analogous to funding under section 159ZC of the Education Act 1989; or
(iii) which is of a kind that the chief executive considers is analogous to a course that is funded under section 159ZC of the Education Act 1989";
(b) by revoking paragraph (a) of subclause 5.2.2.
5. Savings-Where a person has been granted an allowance in respect of a particular course of study under the programme before 1 January 2007, his or her entitlement to receive payments of that allowance must, until the close of
31 December 2009, be determined as if the amendment made by clause 4 (a) had not been made.
Explanatory Note
This note is not part of the amendment, but is intended to indicate its general effect.
This amendment to the Training Incentive Allowance Programme, which comes into effect on 1 January 2007, limits the kinds of courses for which payments of training incentive allowances can be made to those that meet quality and relevance standards set by the Tertiary Education Commission.
Recipients of allowances for existing courses can continue to receive payments until 31 December 2009 or the earlier end of their courses.
