Fisheries (Koukourarata Mataitai Reserve Bylaws) Notice 2006 (No. F370)

Pursuant to Regulations 25 and 26 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Minister of Fisheries hereby gives the following notice.
N o t i c e
1. Title and commencement—(1) This notice may be cited as the Fisheries (Declaration of Koukourarata Mataitai Reserve Bylaws) Notice 2006.
(2) This notice shall come into effect 28 days after the date of its notification in the New Zealand Gazette.
2. Interpretation—In this notice:
(a) The term “Koukourarata Mataitai Reserve” means the mataitai reserve at Koukourarata (Port Levy), Banks Peninsula notified in the Fisheries (Declaration of Mataitai Reserve) Notice 2000 (No. F.167) (New Zealand Gazette, 14 December 2000, No. 166, page 4353).
(b) The term “Te Runanga o Koukourarata office” means either the runanga office located at Level Two, 127 Armagh Street or at 156 Pa Road, Port Levy.
(c) The term “cockle” means the mollusc Austrovenus stutchburyi (formerly Chione stutchburyi).
(d) Terms have, unless the context otherwise requires, the same meaning as defined in the Fisheries
(South Island Customary Fishing) Regulations 1999.
3. Approval of bylaws for the Koukourarata Mataitai Reserve—The Minister of Fisheries hereby approves the following bylaws for the Koukourarata Mataitai Reserve:
(a) Except as provided in subclause (b) below, the taking or possession of cockles from within the Koukourarata Mataitai Reserve is prohibited.
(b) On any Saturday or Sunday during the month of September, a person may take or possess cockles from within the Koukourarata Mataitai Reserve provided that:
(i) prior to the taking or possession, the person has obtained and completed a cockle catch reporting form available from the Te Runanga o Koukourarata office;
(ii) no person shall in any one day take or possess
more than 12 cockles from the Koukourarata Mataitai Reserve; and
(iii) no person shall take cockles by any method other than hand-gathering from the Koukourarata Mataitai Reserve.
4. Fishing subject to these bylaws—Under Regulations 25 (3) of the Fisheries (South Island Customary Fishing) Regulations 1999, all fishing within the Koukourarata Mataitai Reserve is subject to these bylaws.
5. Breach of bylaws is an offence—Under Regulation 43 of the Fisheries (South Island Customary Fishing) Regulations 1999, a person commits an offence against those Regulations if the person breaches any of these bylaws.
6. Revocation—The Fisheries (Declaration of Koukourarata Mataitai Reserve Bylaws) Notice 2001 (No. F201) published in the New Zealand Gazette, 27 September 2001, No. 132, page 3382, is hereby revoked.
