Amendment to the Constitution of the Universal College of Learning 2006

Pursuant to section 170 of the Education Act 1989, the Minister of Education gives the following notice.
N o t i c e
1. This notice may be cited as the Amendment to the Universal College of Learning Constitution Notice 2006, and will come into force on the date of its publication in the New Zealand Gazette.
2. The constitution of the Universal College of Learning (UCOL) Council shall be composed as follows:
(a) Four members appointed by the Minister of Education.
(b) The Chief Executive of the UCOL.
(c) One permanent member of the academic staff of
the UCOL elected by the permanent members of that staff.
(d) One permanent member of the general staff of
the UCOL elected by the permanent members of that staff.
(e) One member who is or who has been a student of the UCOL who shall represent the students of the UCOL and who shall be elected by the students of the UCOL.
(f) One member appointed by the iwi of the tangata whenua resident in the Manawatu, Wanganui, Horowhenua and Wairarapa regions served by the UCOL.
(g) After consultation with the council, one member appointed by the branches of associations of employers and manufacturers for the region.
(h) After consultation with the council, one member appointed by the Combined Trade Union Local Affiliates Councils for the region.
(i) No more than four members appointed by the council after nomination by any member of the public following advertisements in the local newspapers.
(j) No more than five members to be co-opted by the UCOL Council if and when it sees fit.
3. Permanent employees of the UCOL may not be appointed, elected or co-opted as members of the council under paragraphs (e), (f), (g), (h), (i) and (j) of clause 2.
4. The term of office of members of council, vacation of office, disclosure of members’ interests and casual vacancies are covered in sections 173 to 176 of the Education Amendment Act 1989. Subject to section 173 of that Act, the maximum term for any member, other than the chief executive, shall be four consecutive four-year terms, provided that the council may co-opt a member who has served under paragraphs (a), (1), (g), (h), or (1) of clause 2 for a further single term of four years.
5. The powers of the council of the UCOL shall not be affected by vacancy in the membership thereof.
6. The notice constituting the Council of Manawatu Polytechnic, New Zealand Gazette, 11 October 1990, No. 176, page 3801, is revoked (the name of Manawatu Polytechnic was changed to the Universal College of Learning by notice appearing in New Zealand Gazette,
21 September 2000, No. 132, page 3379).
