Notice is hereby given, in accordance with section 94 (2) of the Motor Vehicle Sales Act 2003, that a Motor Vehicle Disputes Tribunal has found against the following motor vehicle traders:
MVD 92/05Decision No.: Ak. 19/05 Car CHB.CO.NZ Limited Rescission ordered – trader is to pay a sum not exceeding $9,990.00 to Credit Union Bayside to discharge the security.
MVD 171/05Decision No.: Ak. 169/05 R & Y Mead Limited (trading as Topcars Direct) Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $2,000.00 plus any capital payments and insurance refunds plus costs of $50.00.
MVD 179/05 Decision No.: Ak. 195/05 Collins Autos Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $4,000.00 plus compensation of $891.60 plus any capital payments and insurance refunds.
MVD 229/05Decision No.: Ak. 16/06 YDL Enterprises Limited (trading as Ace Motors) Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $27,000.00.
MVD 243/05Decision No.: Ak. 17/06 Kelston Autos Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay any capital payments and insurance refunds plus costs of $50.00.
MVD 247/ 05Decision No.: Ak. 18/06 Voyager Holdings Limited (trading as Ultra Cars) Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay any capital payments and insurance refunds plus costs of $50.00.
MVD 270/05Decision No.: Ak. 7/06 Duna Holdings Limited (trading as Kevin McKenzie Motors) Trader is ordered to pay the purchaser $4,500.00.
MVD 290/05Decision No.: Ak. 20/06 Lincoln Car Co (2000) Limited (trading as Lincoln Cars) Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $4,612.75 and costs of $50.00.
MVD 298/05Decision No.: Ak. 22/06 Senroa Limited (trading as Drive Cars) Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser the sum of $370.28 plus any capital payments and insurance refunds plus costs of $50.00.
MVD 300/05Decision No.: Ak. 25/06 Vital IP Limited (trading as Metro Automotive) Ordered that the trader uplift the vehicle from the purchaser and transfer it to D & G Thomson Motors Limited for that company to carry out the repairs and then obtain a warrant of fitness, all at the trader’s cost before returning the vehicle to the purchaser.
MVD 14/06Decision No.: Ak. 26/06 Minami Motors Limited Ordered that the purchaser return the vehicle to the trader. Trader is ordered to pay the purchaser $3,000.00 plus any capital payments and insurance refunds plus costs of $50.00.
