In the matter of the Law Practitioners Act 1982
Pursuant to section 119 of the Law Practitioners Act 1982, notice is hereby given that on 7 December 2005, the
New Zealand Law Practitioners Disciplinary Tribunal ordered as follows:
THAT
1. The practitioner Mark Henley-Smith, of Auckland, be suspended from practice as a barrister and solicitor for a period commencing on Friday, 27 January 2006 at 5.00 p.m. and concluding on Friday, 31 March 2006 at 5.00 p.m.
2. For a period of two years commencing on 1 April 2006, the practitioner shall:
(a) make his practice available for inspection at
six-monthly intervals by an audit inspector appointed by the New Zealand Law Society. The costs of such inspections are to be met by
the practitioner.
(b) take advice in relation to the management of his practice from such a person or persons to be nominated by him and approved by the Auckland District Law Society and the chair of the tribunal before 1 April 2006. The cost of such advice to be met by the practitioner.
3. The practitioner pay to the New Zealand Law Society the sum of $5,679.29.
4. The practitioner pay to Auckland District Law Society the sum of $10,000.00.
