I, Bruce John Maroc, Deputy Director of Monitoring
and Compliance, Maritime New Zealand, being satisfied that the granting of this exemption will not breach
New Zealand’s international obligations, and pursuant to sections 47 (2) (b) and 47 (3) of the Maritime Transport Act 1994, acting under delegated authority, hereby give notice as follows:
The owner and master of MV Arahura (MSA 100029)
is exempt from the requirement in Rule 31A.7 (1) (a) and (c) of Part 31A of the Maritime Rules in relation to the carriage of a Marine Engineer Class 1 (MEC 1) for the period of 0845 hours 12 July 2006 to 0900 hours 19 July 2006 inclusive, subject to the following conditions:
1. Actions must be taken to ensure the ship complies with Maritime Rule 31A.7 (1) (a) and (c) at the owner’s earliest convenience and not later than 0900 hours
19 July 2006; and
2. an additional Marine Engineer Class 2 (MEC 2) is carried in place of the required MEC 1.
The exemption from the provisions of Maritime Rule 31A.7 (1) (a) and (c) shall remain in force until:
(a) one or more of the above conditions is not met;
(b) the ship undergoes major alteration or its operating limits are permanently changed;
(c) the ownership of the ship is changed;
(d) the exemption is revoked by the Director of Maritime New Zealand; or
(e) the expiry date;
whichever occurs first.
This exemption shall expire on 19 July 2006 at 0900 hours.
For the avoidance of doubt, the Notice of Imposition of a Condition in respect of ships owned by Toll NZ Consolidated Limited dated 3 May 2005 shall be varied accordingly for the period of this exemption, to the effect that a MEC 2 may be substituted for the required MEC 1 in the ship’s engine room for MV Arahura while operating in pilotage area and while the main engine is on standby.
