Take notice that on the 13th day of May 2005, an application for an order, under section 174 of the Companies Act 1993, in respect of Calwell Slipway Nelson Limited was filed in the High Court at Nelson.
The orders sought are:
(a) An order that the defendant company repay to the plaintiffs certain sums of money there specified totalling $365,745.12 (together with some ongoing charges) with an alternative order for the taking of accounts; and
(b) An order that Nalder & Biddle Marine and Industrial Coatings Limited, Nalder & Biddle (Nelson) Limited and Nalder & Biddle Marine Railway Limited be jointly and severally liable
to purchase the plaintiffs’ shares in the defendant company at a price stipulated in the application.
The application is to be heard before the High Court at Nelson on the 15th day of July 2005 at 10.00 a.m.
Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before
that day.
