Land Transfer Act Notice

Notice is hereby given that the applicants described below have applied, under section 70 of the Land Transfer Act 1952, for the removal of an easement. The applicants claim the easement is redundant by reason of the circumstances set out below.
I intend to remove the easement on the 26th day of January 2006, if no objections have been received before that date.
Application: 6638956.1.
Applicants: Kimber Alexander Buglass and Jocelyn Antoinette Buglass.
Easement: Water and pipeline rights over Lot 13, DP 7636, Hawke’s Bay Survey District, comprised in Computer Freehold Register HB183/94, created by transfers 181823 and 163720, dated the 25th day of May 1961.
Circumstances: The well and pipeline created transfers 181823 and 163720 have not been used for at least nine years and the dominant tenements are all connected to the Napier City Council reticulated water supply system. The easement is redundant as there is no water to convey over the servient tenement to the dominant tenement.
