The applicant described below has applied, under section 70 of the Land Transfer Act 1952, for the removal of a water
easement. The applicant claims the water easement is redundant by reason of the circumstances set out below. I intend to remove the water easement on the 18th day of April 2005, if no objections have been received before that date.

Applicant: JEC Properties Limited, care of Papprill Hadfield & Aldous, Solicitors, P.O. Box 376, Christchurch.
Easement: A water easement over Lot 4, DP 52141, comprised in Computer Freehold Register CB30F/274, created by transfer 392854, registered on the 25th day of February 1954.
Circumstances: The easement provided that the right to take water shall continue “so long as and wherever water shall
flow therein”. Water has ceased to flow in the water race. Consequently, the easement is no longer used by the registered proprietors of the servient or dominant tenements.
