Pursuant to sections 20 and 28 of the Public Works
Act 1981, and to a delegation from the Minister for
Land Information, Trevor Knowles, Land Information
New Zealand, declares that, an agreement to that effect having been entered into, creating:
1. right of way with the rights and powers set out in paragraphs 6 and 10 to 14 inclusive of Schedule 4 of the Land Transfer Regulations 2002;
2. right to convey water together with the rights and powers set out in paragraphs 3 and 10 to 14 inclusive of Schedule 4 of the Land Transfer Regulations 2002, except that the words
“in common with the grantor and other persons to whom the grantor may grant similar rights”
in paragraph 3 (i) shall be deleted; and
3. right to convey electricity together with rights and powers set out in paragraphs 7 and 10 to 14 inclusive of Schedule 4 of the Land Transfer Regulations 2002, except that the words
“as agreed by the grantor at the time of installation of the facility”
in paragraph 7 (3) shall be deleted
are hereby acquired over the land described in the Schedule to this notice, appurtenant to Section 1, SO 349568 and shall vest in the Western Bay of Plenty District Council on the date of publication of this notice in the New Zealand Gazette.
