Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister for Land Information, R. J. Sutherland, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the easement described in the First Schedule
to this notice is acquired upon the terms and conditions described in the Second Schedule and shall vest in the Crown (called “the grantee”) on the date of publication
of this notice in the New Zealand Gazette.

First Schedule
Easement to be Acquired
An easement in gross for drainage purposes over part Lot 1, DP 313978; marked “A” on DP 348999 (part Computer Freehold Register 55357) and part Lot 2, DP 313978; marked “B” on DP 34899 (part Computer Freehold Register 55358 (together called “the easement land”)).
Second Schedule
Terms and Conditions
1. The grantee shall have the right to enter and remain upon the easement land for the purposes of inspecting, maintaining, re-laying, repairing, replacing, or altering the culvert and stilling pond and opening up the soil of the easement land and make any cuttings, trenches and fillings, and to open the same and generally to do and perform such acts or things upon the easement land as may be necessary to enable the grantee to receive the full use and enjoyment of the rights granted to the grantee.
2. To use the culvert and stilling pond for the purposes of an easement without interruption or impediment.
3. The grantee will make good any damage to the easement land directly or indirectly arising from the construction of the culvert and stilling pond.
